Meet Maya and Will, Philosophy, Politics and Law majors at Binghamton University. Over the coming months, they'll gain hands-on experience working alongside our staff as they learn more about the criminal justice system and public service.

Today our office hosted an Animal Crimes Training for local law enforcement at the SUNY Broome Community College Culinary Center, and we couldn't be more thankful for the people who made it happen.

𝗕𝗿𝗼𝗼𝗺𝗲 𝗖𝗼𝘂𝗻𝘁𝘆 𝗗𝗶𝘀𝘁𝗿𝗶𝗰𝘁 𝗔𝘁𝘁𝗼𝗿𝗻𝗲𝘆 𝗙. 𝗣𝗮𝘂𝗹 𝗕𝗮𝘁𝘁𝗶𝘀𝘁𝗶 announced today that Thanh V. Nguyen, 52, of Binghamton, was found guilty as charged of Attempted Assault in the First Degree and Assault in the Second Degree following a Jury Trial in Broome County Court before the Honorable Carol A. Cocchiola.

The charges stem from an incident that occurred on May 8, 2025, at the Greater Binghamton Health Center, where the Defendant attacked a mental health aide and a Peace Officer.

During the incident, the Defendant swung a pen toward the face of a mental health aide with the intent to strike the victim in the eye and cause serious physical injury. The pen ultimately struck the victim approximately one centimeter from the victim’s eye.

The Defendant subsequently resisted efforts by a Peace Officer to disarm him. After lengthy verbal de-escalation attempts, the Defendant bit the Peace Officer in the ear, causing physical injury.

"The men and women who work in our health care facilities and serve as Peace Officers deserve to do so without the fear of being attacked. This conviction sends a clear message that violence against health care workers and Peace Officers will not be tolerated in Broome County. The Broome County District Attorney's Office is committed to holding those who harm our healthcare professionals and public servants fully accountable." said 𝗗𝗶𝘀𝘁𝗿𝗶𝗰𝘁 𝗔𝘁𝘁𝗼𝗿𝗻𝗲𝘆 𝗙. 𝗣𝗮𝘂𝗹 𝗕𝗮𝘁𝘁𝗶𝘀𝘁𝗶

As a second violent felony offender, Nguyen faces a potential sentence ranging from a minimum of 15 years to life imprisonment to a maximum of 25 years to life imprisonment if found to be a persistent felony offender.

The case was prosecuted by Senior Assistant District Attorney Alexander Czebiniak on behalf of the Broome County District Attorney's Office with assistance from District Attorney Investigator Matthew Brubaker. This case was investigated by the Binghamton Police Department and the Office of Mental Health.

Sentencing is scheduled for December 16, 2026, at 9:00 a.m. in Broome County Court

𝐁𝐫𝐨𝐨𝐦𝐞 𝐂𝐨𝐮𝐧𝐭𝐲 𝐌𝐚𝐧 𝐏𝐥𝐞𝐚𝐝𝐬 𝐆𝐮𝐢𝐥𝐭𝐲 𝐭𝐨 𝐂𝐨𝐮𝐫𝐬𝐞 𝐨𝐟 𝐒𝐞𝐱𝐮𝐚𝐥 𝐂𝐨𝐧𝐝𝐮𝐜𝐭 𝐀𝐠𝐚𝐢𝐧𝐬𝐭 𝐚 𝐂𝐡𝐢𝐥𝐝

Broome County District Attorney F. Paul Battisti announced today that Wesley G. Earle, 55, of Johnson City, plead guilty in Broome County Court before the Honorable Carol A. Cocchiola to Course of S*xual Conduct Against a Child in the First Degree, a Class B Violent Felony.

“This guilty plea holds the Defendant accountable for his conduct,” 𝐬𝐚𝐢𝐝 𝐃𝐢𝐬𝐭𝐫𝐢𝐜𝐭 𝐀𝐭𝐭𝐨𝐫𝐧𝐞𝐲 𝐅. 𝐏𝐚𝐮𝐥 𝐁𝐚𝐭𝐭𝐢𝐬𝐭𝐢. “This type of conduct is heinous and has no place in our community. Our office is committed to seeking justice for children and victims of crime, and we will continue to work closely with Law Enforcement and Victim Advocates to hold those responsible for their actions.”

During the plea proceeding, Earle admitted that, between January 2015 and January 2017, he engaged in s*xual acts with a child under the age of thirteen (13).

Earle is scheduled to be sentenced on December 18, 2026, in Broome County Court. Pursuant to the plea agreement, Earle will receive a sentence of fifteen (15) years in State Prison, followed by ten (10) years of post-release supervision.

As part of his sentence, Earle will also be required to register as a s*x offender and comply with all applicable terms and conditions under the S*x Offender Registration Act (SORA), as well as an order of protection prohibiting contact with the victim.

The investigation was conducted by the New York State Police.

Senior Assistant District Attorney Alex Czebiniak is prosecuting the case on behalf of the Broome County District Attorney’s Office, with assistance from District Attorney Investigator John Chapman.

Events like this provide a wonderful opportunity to meet local Law Enforcement, community members, and neighbors building relationships and strengthening the connection between those who serve and the community they serve.

Our office had the opportunity to present alongside our law enforcement partners at the New York State Police and the Southern Tier Crime Analysis Center, sharing a roadmap for success in strengthening our intimate partner violence response with STRIVE.

Our office would like to extend our sincere appreciation to Sheriff Michael Chitwood of the Volusia Sheriff's Office and his department for their outstanding work and partnership in bringing Scott Mitchell into custody following the February 3, 2025 double homicide in Binghamton.

The successful apprehension of Mitchell in Daytona Beach was the result of strong collaboration between Law Enforcement agencies across state lines. We are grateful to the deputies and investigators who responded to the information received, located Mitchell, and safely took him into custody.

Our office also extends our appreciation to the Binghamton Police Department and all of the Law Enforcement partners whose efforts contributed to this case.

Thank you to the men and women of the Volusia County Sheriff’s Office for your professionalism, dedication, and commitment to public safety.

Partnerships like this demonstrate what can be accomplished when Law Enforcement agencies work together.

CASE UPDATE: Scott Mitchell, the New York double homicide suspect caught in Daytona Beach last year, has been convicted of all counts in the murders of Daniel McCloe and Marshall VanOven.

Mitchell was found guilty in the Feb. 3, 2025, murders in Binghamton, NY:

Mitchell strangled both men with a rope before hitting them in the back of the head with a wrench in the basement of a home in Binghamton. Mitchell then took both bodies, stripped them of their clothes, and put them into trash cans in his garage.

After the murders, Mitchell fled to Florida. We partnered with Binghamton PD on posting a $10,000 reward for information leading to his capture. On Feb. 12, we got a tip about a sighting in Daytona Beach, and deputies arrested Mitchell without incident. The caller received $10,000. Mitchell is facing life in prison at sentencing.

Our office spent this afternoon at the Fenton Town Hall, talking with local senior citizens about how to spot and stop scams.

We walked through real cases we’ve seen, the tactics scammers use to create urgency, and the three steps that work no matter what the scam is: Stop, Verify, Report.

Everyone left with a resource card with local law enforcement agencies contact information on it.

2 counts of Concealment of a Human Co**se
2 counts of Tampering with Physical Evidence
