‼Governor Kelly Armstrong and Attorney General Drew Wrigley have taken executive action regarding the sale, use, and possession of kratom products in North Dakota:

➡An executive order has been issued, declaring a public health emergency and prohibiting the sale, use and possession of all kratom and kratom products in North Dakota, effective at 5 pm on Wednesday, August 5, 2026.

➡An emergency rule has been issued by the North Dakota Board of Pharmacy and signed the Governor to classify 7-OH as a Schedule 1 controlled substance. The board’s emergency rule is valid for 180 days and triggers an emergency administrative rulemaking process.

➡An executive order has been issued to convene a special session of the Legislature, beginning on Wednesday, September 2, 2026, to address enactment of the emergency rule on 7-OH, to place the prohibition on kratom into state law and to address enforcement authority.

📢Per the Governor’s Office, retailers who sell kratom, 7-OH and kratom products are advised to review existing inventory, work with suppliers to identify and remove affected products, and discontinue purchases from suppliers.

ℹ Individuals concerned about recovery or withdrawal from kratom products may seek help 24/7/365 by calling or texting 988, the crisis lifeline, or 211, the information and referral helpline.
✅Help can also be obtained from the Northwest Behavioral Health Clinic (316 2nd Ave W, Williston) during their open access hours, 8 am to 5 pm, Monday – Friday.
